1. Data Controller

The Data Controller is Sans Serif Sagl, Vial da la Stazion 2, 7742 Poschiavo, Switzerland — VAT CHE-206.633.328 — info@mondocamgirls.com. This notice applies to the websites https://mondocamgirls.com and https://mondocamgirls.net (the “Site”).

2. Applicable law

Sans Serif Sagl is established in Switzerland and processes personal data in accordance with the Swiss Federal Act on Data Protection (FADP) and its implementing Ordinance.
Because the Site is directed at users located in the European Union, the EU General Data Protection Regulation (GDPR) also applies to the processing of their personal data.
Switzerland benefits from an adequacy decision of the European Commission. Transfers of personal data from the European Economic Area to Switzerland therefore take place within a jurisdiction recognised as providing an adequate level of protection.

3. Personal data we process

Account and registration data: username, email address, password (stored in encrypted form), language preference, date of registration, and IP address recorded at registration and at subsequent logins.
Transaction data: purchases made, amounts, currency, date and time, payment method, wallet balance, and transaction identifiers. We do not store full payment card numbers; card data is processed directly by our payment service providers.
Communications and service data: communications exchanged and sessions conducted through MondoChat, and data relating to the booking and delivery of services (see point 5).
Identity and age verification data (models only): government-issued identity document, date of birth, and records of consent, processed as described in point 6.
Technical and usage data: IP address, device and browser type, operating system, pages visited, time spent, referring source, and interactions with the Site, collected through cookies and similar technologies (see point 12).

4. Purposes of processing and legal basis

We process data for the following purposes, each with its corresponding legal basis under the GDPR:
– Creating and managing your account; providing the services you request — Art. 6.1.b, performance of a contract.
– Processing payments, managing wallet balances and refunds — Art. 6.1.b, performance of a contract.
– Verifying that a paid service was delivered as agreed; handling disputes and chargebacks — Art. 6.1.b and Art. 6.1.f, legitimate interest in defending claims and in meeting obligations towards payment providers.
– Verifying the identity and age of models before activation — Art. 6.1.c, legal obligation; Art. 9.2.g where special categories of data are involved.
– Moderating content and communications to prevent illegal material and protect minors — Art. 6.1.c, legal obligation; Art. 6.1.f, legitimate interest in platform safety.
– Preventing fraud and abuse — Art. 6.1.f, legitimate interest.
– Site security, availability and technical performance — Art. 6.1.f, legitimate interest.
– Analytics and improvement of the Site — Art. 6.1.a, consent given through the cookie banner.
– Marketing communications — Art. 6.1.a, consent, withdrawable at any time.
– Complying with accounting, tax and legal obligations — Art. 6.1.c, legal obligation.
Under the FADP, the corresponding bases are the performance of a contract, compliance with a legal obligation, an overriding private or public interest, or consent.

5. MondoChat — communications and delivery of services

MondoChat is the communication and service-delivery environment integrated into the Site. Contact between users and models relating to paid services, agreement on the type, duration and price of a service, scheduling, and delivery of the service take place through MondoChat.
Data processed: content of communications exchanged through MondoChat; booking and delivery data (service type, duration, agreed price, date and time); and technical session metadata (account identifiers, IP address, date, time and duration of connection).
Purposes: performance of the contract and verification that a service was delivered as agreed; prevention of illegal content and protection of minors; fraud prevention and the handling of payment disputes and chargebacks; and compliance with requests from competent authorities.
Method: communications and sessions conducted through MondoChat are subject to automated screening and, where a report is received, a transaction is disputed, or where required by law, to review by authorised personnel bound by confidentiality obligations. Review is limited to what is necessary for the purposes stated above and is not used for commercial or profiling purposes.
The record of what was agreed in MondoChat is what allows us to verify whether a service was delivered as agreed and to resolve disputes in your favour where it was not. Services arranged outside MondoChat cannot be verified and are not covered by these protections.

6. Identity and age verification

All persons appearing in sexually explicit content on the Site were at least 18 years of age at the time the content was created.
Before a model is permitted to publish content, we verify their identity and age using a valid government-issued identity document. Verification is carried out through a specialised third-party identity verification provider acting as our data processor.
Records of these verifications and of each model’s consent are retained for the period required by applicable law and are disclosed only to competent authorities or where otherwise required by law.

7. Recipients of personal data

We do not sell personal data. We disclose it only as follows:
– payment service providers and card schemes, for the execution of transactions and the investigation of disputed transactions and chargebacks;
– identity verification providers, for the purposes described in point 6;
– technical service providers (hosting, content delivery, security, customer support and analytics providers), acting as data processors under written agreements;
– competent authorities, where required by law or in response to a lawful request;
– legal and professional advisers, where necessary for the establishment, exercise or defence of legal claims.
Processors act only on our documented instructions and are bound by confidentiality and security obligations.

8. International transfers

Personal data is processed primarily in Switzerland and the European Economic Area. Where a processor is located outside these territories, the transfer takes place on the basis of an adequacy decision, of Standard Contractual Clauses approved by the European Commission and recognised by the Swiss Federal Data Protection and Information Commissioner, or of another lawful transfer mechanism. You may request further information on the safeguards applied by contacting us at the address in point 1.

9. Retention

Account data: for the duration of the account, and 12 months after closure.
Transaction and accounting records: 10 years, as required by Swiss accounting and tax law.
MondoChat communications and service agreements: for the time necessary to handle disputes, and no longer than the periods provided by law.
Identity and age verification records (models): for the period required by applicable law.
IP addresses recorded for fraud prevention: retained after account closure as part of our fraud-prevention measures.
Marketing consent records: until consent is withdrawn, plus the applicable limitation period.
Analytics data: as set out in point 12.
Where data is no longer required for the purpose for which it was collected, it is deleted or anonymised.

10. Security

We apply technical and organisational measures appropriate to the risk, including encryption of data in transit, encrypted storage of credentials, access controls limiting access to authorised personnel, logging of administrative access, and periodic review of our security measures. No system can be guaranteed to be completely secure. You are responsible for keeping your password confidential and for notifying us promptly of any suspected unauthorised access to your account.

11. Your rights

You have the right to: access the personal data we hold about you and obtain a copy; rectify inaccurate or incomplete data; erase your data, subject to the limitations below; restrict processing in the circumstances provided by law; receive in a structured, machine-readable format the data you provided (data portability); object to processing based on legitimate interest, including profiling; withdraw consent at any time, without affecting the lawfulness of processing carried out before withdrawal; and not be subject to a decision based solely on automated processing producing legal or similarly significant effects.

Exercising the right to erasure does not affect data we are required to retain to comply with legal, accounting or tax obligations, or data necessary for the establishment, exercise or defence of legal claims, including the defence of disputed payments.
If you are located in the European Economic Area, you may lodge a complaint with the supervisory authority of your country of residence. If you are located in Switzerland, you may contact the Federal Data Protection and Information Commissioner (FDPIC), Feldeggweg 1, 3003 Bern.

Definitions

Where models link to their social media profiles from their page on the Site, following such a link takes you to a third-party platform governed by that platform’s own privacy policy. We have no control over the processing carried out by those platforms.

Duration of cookies

Some cookies (session cookies) remain active only until the browser is closed or the logout command is executed. Other cookies “survive” the closing of the browser and are also available on the user’s subsequent visits. These cookies are called persistent and their duration is set by the server at the time of their creation.
